TERMS AND CONDITIONS
1. Parties
This agreement is between B62 Dental ("the Practice"), trading from 32 Halesowen Road, Halesowen, B62 9AB, and the individual named on the sign-up form ("the Member").
2. The Membership Plan
2.1 The membership plan provides the Member with the dental benefits listed on this page for the plan selected, subject to these terms and conditions.
2.2 The membership plan is not a dental insurance policy and does not provide cover for emergency dental treatment required outside the Practice.
2.3 Benefits are personal to the Member and cannot be transferred to any other person.
3. New Patient Examination — Important Notice
3.1 The initial new patient examination and any X-rays taken at the first visit are not included in the membership plan and are charged separately at the Practice's standard fee (currently £60 for the new patient consultation, plus £9 per X-ray if required).
3.2 Membership benefits (check-ups, hygienist appointments, emergency appointments, and discounts) commence from the Member's second visit onwards, following completion of the new patient examination.
4. Excluded Treatments
The following are excluded from the membership plan. The 10% member discount may still apply to some of these at the Practice's discretion — please ask:
- Orthodontic treatment (including Invisalign, unless a consultation only)
- Cosmetic treatments (including teeth whitening and veneers)
- Dental implants
- Prescribed medicines and drugs for home use
- General anaesthesia, IV sedation and inhalation sedation
- Oral hygiene products and aids supplied at the Practice
- Treatment provided on referral to another dentist or specialist
- Mouthguards and sports guards
- Out-of-hours call-out fees
5. Payment and Direct Debit
5.1 The monthly membership fee is payable by Direct Debit, administered by GoCardless Ltd, an authorised payment institution regulated by the Financial Conduct Authority (FRN 597190).
5.2 Payments are collected on or around the same date each month. The Member will receive advance notice of the first collection date in accordance with the Direct Debit Guarantee.
5.3 The Member is protected by the Direct Debit Guarantee. If an error is made in the payment of a Direct Debit, the Member is entitled to a full and immediate refund from their bank or building society.
6. Minimum Term and Cancellation
6.1 This agreement has a minimum term of 12 months from the date the Member's first Direct Debit payment is collected.
6.2 This agreement automatically renews for successive 12-month periods at the end of each term. If the Member does not wish to renew, they must give at least 30 days' written notice before the renewal date by email to reception@b62dental.com. If notice is not received before the renewal date, the agreement will renew for a further 12 months and the monthly Direct Debit will continue to be collected accordingly.
6.3 If the Member cancels within the minimum 12-month term, the Practice reserves the right to charge for the full value of any treatments already received under the plan at standard (non-member) rates, minus the total Direct Debit payments already made by the Member for that annual period.
6.4 Cancellation during an ongoing course of treatment will take effect on completion of that course of treatment.
7. Appointment Attendance
7.1 Appointments must be cancelled with a minimum of 48 hours' notice, excluding bank holidays and weekends (i.e. 48 working hours on a Monday–Friday basis). Appointments cancelled with less than 48 hours' notice, or not attended, will be counted as having been used under the membership plan for that year and cannot be redeemed again within the same plan year.
7.2 Unused benefits do not carry over to the following plan year.
8. Non-Payment
8.1 If a monthly fee remains unpaid for 30 days after its due date, the Practice may suspend membership benefits until payment is received.
8.2 If a monthly fee remains unpaid for 60 days, the Practice may terminate this agreement by giving 1 month's written notice. The Member will remain liable for all sums outstanding under this agreement.
9. Changes to Fees or Benefits
9.1 The Practice may review and amend the monthly fee or the benefits included in the plan no more than once per 12-month period.
9.2 The Member will be given at least 30 days' written notice of any change to the monthly fee or benefits. If the Member does not wish to accept the changes, they may cancel the agreement in accordance with clause 6.2 without penalty, provided notice is given before the changes take effect. This right is in addition to any statutory rights the Member may have under the Consumer Rights Act 2015.
10. Complaints
10.1 The Practice operates a formal complaints procedure. Any concerns should first be raised with the Practice Manager at reception@b62dental.com or in writing to the Practice address.
10.2 If a complaint cannot be resolved by the Practice, the Member may refer the matter to the Dental Complaints Service (provided by the General Dental Council) at dentalcomplaints.org.uk or 020 8253 0800.
11. Data Protection
11.1 The Practice will process the Member's personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, for the purposes of administering this membership agreement and providing dental care. Full details of how we collect, use, store and protect personal data — including membership sign-up data, IP address retention and Direct Debit processing — are set out in our Privacy Notice.
11.2 By signing up to a membership plan, the Member acknowledges that they have read and understood the Privacy Notice. Sign-up details including name, email, phone number, IP address and the date and time of sign-up are retained as an audit record of acceptance of these terms, for a period of six years following the end of the agreement.
11.3 The Practice will not share the Member's personal data with third parties except as necessary to administer the Direct Debit (GoCardless Ltd), deliver transactional emails (Resend) or as required by law.
11.4 The Member has the right to access, correct or request deletion of their personal data. Please contact reception@b62dental.com to exercise these rights.
12. Governing Law
This agreement is governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Consumer Rights
Nothing in these terms and conditions affects the Member's statutory rights under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.
14. Entire Agreement
These terms and conditions, together with the plan benefits listed on this page at the time of sign-up, constitute the entire agreement between the parties in relation to the membership plan.
